You do not have to provide any information to us in order to use our Site; however, you must comply with these Terms of Service. If you choose to submit personal information to us, the terms of our Privacy Policy will apply.

Bach to Rock is a modern music school making learning music fun for students of all ages and all skill levels. We offer private instruction, group practice, and live performance.

Our Site provides our visitors (“you” or “your”) with information about our business, products, and Services and allows users to register for and purchase certain Services. PLEASE READ THESE TERMS OF SERVICE CAREFULLY. BY USING OUR SITE, YOU AGREE TO THESE TERMS OF SERVICE AND AGREE TO BE BOUND BY THEM.

Our Site may, from time to time, display employment opportunities offered by us. If you are interested in applying for an employment opportunity, you may be able to submit your candidacy credentials and application through our Site. Please note that information that you submit in connection with an employment opportunity may contain personal information and will be subject to the terms of our Privacy Policy.

THE TERMS OF SERVICE CONTAIN A BINDING, INDIVIDUAL ARBITRATION, CLASS ACTION, AND JURY WAIVER PROVISION. BY ACCEPTING THESE TERMS OF SERVICE, YOU AND BACH TO ROCK AGREE TO RESOLVE DISPUTES THROUGH BINDING, INDIVIDUAL ARBITRATION. THIS MEANS YOU AND BACH TO ROCK ARE WAIVING THE RIGHT TO HAVE DISPUTES DECIDED BY A JUDGE OR JURY AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR OTHER REPRESENTATIVE PROCEEDING.

1. Acceptance of Terms

By accessing or using the Site, including registering for an account, enrolling in Services, or making a purchase, you agree to be bound by these Terms of Service. If you do not agree, you must not use the Site.

2. Eligibility

The Site is intended for use by individuals who are at least 18 years old. If you are under the age of 18, you may use the Site only with the involvement and consent of a parent or legal guardian. By using the Site, you represent and warrant that you are either at least 18 years old or using the Site with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms. Accounts used for minors must be created and maintained by a parent or legal guardian. If you are a parent or legal guardian permitting a minor to use the Site or enroll in any Services, you agree to: (a) supervise the minor’s use of the Site; (b) be responsible for all activity conducted by the minor through the Site; and (c) be financially responsible for all charges and obligations incurred in connection with such use. We reserve the right to refuse access to the Site or Services to any person at our discretion.

3. Services; Additional Program Terms

The Site allows users to learn about, register for, and purchase certain in-person music lessons, programs, classes, camps, and events offered by Bach to Rock (the “Services”). Services may be provided either in person at Bach to Rock locations or online, depending on the specific offering, and are subject to availability, scheduling, and acceptance by Bach to Rock. Descriptions of Services on the Site are provided for general informational purposes only and may be updated or modified without notice. We make reasonable efforts to ensure that information about Services is accurate, but we do not warrant that descriptions, pricing, schedules, or other content are complete, current, or error-free. We do not guarantee any particular educational, performance, or other outcomes from participation in the Services.

Enrollment in, participation in, or purchase of any Services may be subject to additional terms, conditions, policies, or agreements (collectively, “Program Terms”), which may include, without limitation, enrollment agreements, payment terms, studio policies, attendance and cancellation policies, codes of conduct, and location-specific requirements. Program Terms may be presented to you at the time of registration, enrollment, or participation, or may otherwise be made available by the applicable Bach to Rock location.

By registering for, purchasing, or participating in any Services, you agree to comply with all applicable Program Terms. In the event of conflict between these Terms of Service and the applicable Program Terms, the Program Terms will control with respect to the applicable Services, except to the extent these Terms expressly govern use of the Site, payment processing, or dispute resolution.

We reserve the right to refuse or cancel any registration or enrollment, including in cases of suspected fraud, unauthorized or unlawful activity, or failure to comply with these Terms of Service or applicable Program Terms.

4. Payments; Third-Party Payment Processors

The Site enables you to register for and purchase Services. By providing a payment method and completing a transaction through the Site, you agree to pay all fees, charges, and applicable taxes associated with your purchase. All payments made through the Site are processed by one or more third-party payment processors (“Payment Processors”). By submitting your payment information, you authorize us and our Payment Processors to charge your selected payment method for the total amount due, including any recurring or subscription-based charges, as applicable. You acknowledge and agree that Payment Processors operate independently from Bach to Rock and are subject to their own terms, conditions, and privacy policies. We do not control and are not responsible for the performance, security, or practices of any Payment Processor, including any errors, delays, charge failures, or technical issues related to payment processing. You agree to provide current, complete, and accurate billing and payment information and to promptly update such information as needed to keep it accurate and valid. If your payment method cannot be charged, is declined, or is otherwise invalid, we may suspend or cancel your registration or access to the Services until payment is successfully completed.

5. Subscriptions and Auto-Renewal

Certain Services may be offered on a recurring or subscription basis (each, a “Subscription”). The applicable billing frequency (e.g., weekly, monthly, or per term), pricing, and other details of your Subscription will be disclosed at the time of enrollment and may be set forth in the applicable Program Terms. By enrolling in a Subscription, you authorize Bach to Rock and its Payment Processors to charge your designated payment method on a recurring basis for all applicable fees, taxes, and other charges, at the intervals disclosed at the time of enrollment.

Unless otherwise stated at the time of enrollment or in applicable Program Terms, Subscriptions will automatically renew for successive periods equal in length to the initial subscription period unless and until canceled. You may cancel your Subscription in accordance with the cancellation procedures provided at the time of enrollment or in the applicable Program Terms. Cancellation requests must be submitted in accordance with those requirements and may take effect at the end of the then-current billing period or as otherwise specified.

We reserve the right to change Subscription fees at any time upon advance notice to you, as required by applicable law. Continued participation in a Subscription after such notice constitutes your acceptance of the updated fees.

If a recurring charge is declined or cannot be processed for any reason, we may suspend or cancel your Subscription or access to Services until payment is successfully completed. Except as otherwise expressly provided in applicable Program Terms or required by law, Subscription fees are non-refundable. You agree to be responsible for all amounts incurred under your account, including any costs we incur in collecting unpaid amounts, to the extent permitted by applicable law, including reasonable collection costs and attorneys’ fees.

6. Fees

You agree to pay all fees, charges, and applicable taxes associated with your purchase or enrollment in any Services (“Fees”), as presented at the time of registration or purchase through the Site or as otherwise set forth in applicable Program Terms. Fees may include, without limitation: (a) one-time charges, such as enrollment, registration, or event fees; and (b) recurring charges associated with Subscriptions, as described in these Terms and any applicable Program Terms. We reserve the right to modify fees for Services at any time prior to purchase or enrollment, and for Subscriptions as provided in Section 5 (Subscriptions and Auto-Renewal). All Fees are stated in U.S. dollars unless otherwise indicated and do not include applicable taxes, which will be added as required by law. You are responsible for all sales, use, and other applicable taxes associated with your purchase, except for taxes based on our net income. Fees are charged at the time of purchase or enrollment, or on a recurring basis for Subscriptions, using the payment method you provide in accordance with these Terms. You authorize us and our Payment Processors to charge your payment method for all Fees incurred. Except as otherwise expressly provided in applicable Program Terms or required by law, all Fees are non-refundable and non-cancelable once charged. If your payment method is declined, expires, or cannot be charged for any reason, you remain responsible for all amounts due, and we may suspend or cancel your access to Services until payment is successfully completed.

7. Service Availability

All Services are subject to availability and acceptance by Bach to Rock and the applicable location. Submission of a registration, enrollment request, or payment through the Site does not guarantee placement in any lesson, program, class, or event. Availability of Services may vary based on factors including, without limitation, instructor availability, scheduling constraints, enrollment capacity, and location-specific offerings. We reserve the right, in our sole discretion, to accept or decline any registration or enrollment request. We may modify, reschedule, suspend, or discontinue any Service, in whole or in part, at any time, including due to instructor availability, minimum enrollment requirements, facility issues, or other operational considerations. In such cases, any applicable remedies, including rescheduling, credits, or refunds, will be governed by the applicable Program Terms and applicable law. We do not guarantee that any Service will be available at a specific date, time, location, or with a particular instructor, and we reserve the right to make substitutions or changes as reasonably necessary. We are not responsible for delays or cancellations due to circumstances beyond our reasonable control, including but not limited to events affecting instructors, facilities, or third-party services.

You also agree to ensure that you log out your account at the end of each session. You should use particular caution when accessing your account from a public or shared computer so that others are not able to view or record your password or other personal information.

We have the right to disable any username, password, or other identifier, whether chosen by you or provided by us, at any time in our sole discretion for any or no reason including, if in our opinion, you have violated any provision of these Terms of Service.

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND. YOUR USE OF THE SITE AND SITE CONTENT IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESSED OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OF THIRD PARTY RIGHTS, AND FITNESS FOR A PARTICULAR PURPOSE. YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE. TO THE EXTENT PERMITTED BY LAW, THE REMEDIES STATED FOR YOU IN THESE TERMS OF SERVICE ARE EXCLUSIVE AND ARE LIMITED TO THOSE EXPRESSLY PROVIDED FOR HEREIN.

15. Limitation on Time to File Claims

ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OF SERVICE OR THE SITE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES; OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.

16. Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Bach to Rock, its affiliates, licensors, service providers, and their respective officers, directors, employees, contractors, agents, and representatives from and against any and all claims, demands, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to: (a) your access to or use of the Site; (b) your registration for, purchase of, or participation in any Services; (c) your violation of these Terms or any applicable Program Terms; (d) your violation of any applicable law or regulation; (e) any User Contributions or content you submit, post, or transmit through the Site; or (f) your infringement or misappropriation of any intellectual property or other rights of any person or entity. If you are a parent or legal guardian permitting a minor to use the Site or participate in any Services, the foregoing indemnification obligations apply to both your actions and the actions of such minor. Bach to Rock reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in such case, you agree to cooperate with our defense of such claim.

17. Privacy Policy

We collect and use certain information about you in accordance with our Privacy Policy. Please review the terms of our Privacy Policy before using our Site. By using our Site, you consent to such collection and processing of your information as described in our Privacy Policy.

18. Geographic Restrictions

The owner of the Site is based in the State of Maryland in the United States. We provide this Site for use only by persons located in the United States. We make no claims that the Site or any of its content is accessible or appropriate outside of the United States. Access to the Site may not be legal by certain persons or in certain countries. If you access the Site from outside the United States, you do so on your own initiative and are responsible for compliance with local laws.

19. Governing Law and Venue

These Terms of Service and any disputes concerning this document’s construction, interpretation, performance or validity, shall be controlled and construed under the laws of the State of Delaware as if performed within the state and without giving effect to the principles of conflicts of laws. Except as otherwise provided in Section 21 (Arbitration of Disputes and Class Action Waiver), any legal action or proceeding arising out of or relating to these Terms of Service or the Services shall be brought exclusively in the state or federal courts located in Montgomery County, Maryland, and you and Bach to Rock consent to the personal jurisdiction of such courts  and waive any objection that based on improper venue or forum non conveniens. Nothing in this Section shall be deemed to limit or modify the parties’ obligation to resolve disputes through binding arbitration as set forth below.

20. Arbitration of Disputes and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND YOUR RIGHT TO SEEK REMEDIES AS PART OF OR ON BEHALF OF A CLASS. THERE IS NO JUDGE OR JURY IN ARBITRATION, AND DISCOVERY PROCEDURES AND APPELLATE RIGHTS ARE MORE LIMITED THAN IN COURT.

Informal Resolution.  Before filing any claim, you and Bach to Rock agree to attempt to resolve the dispute informally by providing written notice describing the claim and the requested relief. If the parties cannot resolve the dispute within thirty days after notice, either party may proceed as provided below.

Binding Arbitration. You agree to resolve any claims relating to these Terms of Service or the Services (whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, and regardless of when a claim arises) through final and binding arbitration conducted by a neutral arbitrator mutually agreed upon by the parties. If the parties cannot agree on an arbitrator, either party may request appointment of a neutral arbitrator by a court of competent jurisdiction. The arbitration will be conducted in Baltimore, Maryland in accordance with the Federal Arbitration Act and, unless otherwise agreed, generally recognized consumer arbitration rules appropriate to the dispute.

Arbitration is less formal than a lawsuit in court. Arbitration uses a neutral arbitrator instead of a judge or jury, may allow for more limited discovery than in court, and can be subject to very limited review by courts. The arbitrator shall have the authority to award any remedies that would be available in a court of competent jurisdiction, and the arbitrator has exclusive authority to resolve any dispute relating to the interpretation, applicability, or enforceability of this binding arbitration agreement. YOU UNDERSTAND AND AGREE THAT, BY ACCEPTING THESE TERMS OF SERVICE, YOU AND BACH TO ROCK ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION AND THAT THIS AGREEMENT TO ARBITRATE DISPUTES SHALL BE SUBJECT TO AND GOVERNED BY THE FEDERAL ARBITRATION ACT.

The foregoing will not, however, be deemed to waive, preclude, or otherwise limit the right of you or Bach to Rock to: (i) bring an individual action in small claims court; (ii) pursue an enforcement action through any applicable federal, state, or local agency if that action is available; (iii) seek injunctive relief in aid of arbitration from a court of competent jurisdiction; or (iv) file suit in a court of law to address an intellectual property infringement claim.

The party seeking to arbitrate any matter must first send a written notice of the dispute to the other party by U.S. Mail (“Notice”). Bach to Rock’s address for Notice is: 4910 Cordell Avenue, Bethesda, MD 20814, Attn: General Counsel. The Notice must: (i) describe the nature and basis of the claim or dispute; and (ii) set forth the specific relief sought (“Demand“). You and Bach to Rock will make good faith efforts to resolve the claim directly, but if we do not reach an agreement to do so within 30 days after the Notice is received, either of us may commence an arbitration proceeding.

Class Action Waiver. WE AND YOU AGREE THAT EACH OF US MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless we agree otherwise in a signed writing, the arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding.

If an arbitrator decides that applicable law precludes enforcement of any of the limitations relating to class, representative and consolidated proceedings as to a particular claim for relief, then that claim (and only that claim) must be severed from the arbitration and brought in court. If any other provision of the Terms of Service is found to be unenforceable, the applicable provision shall be deemed stricken and the remainder of the Terms of Service shall remain in full force and effect.

Jury Trial Waiver. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND BACH TO ROCK KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A JURY TRIAL IN ANY ACTION OR PROCEEDING PERMITTED TO BE BROUGHT IN COURT.

21. Updates to Terms of Service

We may revise these Terms of Service at any time by amending this page of our Site and indicating the most recent version by the date shown at the top.
